1. The operator
Hogsmead Investments (Pty) Ltd t/a Fantasia at Hogsback operates accommodation at 32 Main Road, Hogsback, 5721, Eastern Cape, South Africa. Contact fantasiahogsback@gmail.com or 021 532 9224. Company/business particulars appear in the PAIA manual.
2. Cottage and confirmation
Each cottage is booked separately. The Lantern accommodates two adults; Grace Cottage up to six guests, subject to agreed party details. A booking covers only the named cottage. Obtain separate confirmation if you need both.
A website opening, enquiry or provisional quote is an indication, not a reservation or guarantee. We check availability, occupancy, total price and payment conditions before written direct-booking confirmation. Temporary holds need an express expiry. An invoice alone does not change reservation status; the confirmation and agreed payment conditions govern.
Channel bookings follow the status and accepted terms on Airbnb, Booking.com or LekkeSlaap, subject to mandatory law. A platform-confirmed booking is not made provisional by this notice. Calendar updates can be delayed. We address conflicts promptly with you and the platform; a sync error does not create an automatic 24-hour cancellation right for the operator.
3. Stay length, arrival and departure
New stays have a two-night minimum and one clear night between stays for cleaning. No same-day checkout/check-in. After Monday checkout the next check-in is Tuesday or later, subject to availability. Existing confirmed dates are honoured.
Check-in from 14:30; checkout by 10:00. Check-in after 18:00 requires advance arrangement. Contact us if delayed to agree access.
Late checkout requires advance agreement and availability. Cleaners are on standby from 10:00. An hourly rate, any part-hour calculation and maximum charge must be disclosed and agreed before extending the stay. Ask for the amount: no hourly price is published yet. Charges must be reasonable/proportionate, with no undisclosed automatic fee or punitive debit.
4. Prices, payments and extras
Prices are rand per cottage per night for stated occupancy. Direct accommodation currently reflects a 10% reduction from our standard schedule; channel fees/discounts may differ. Friday/Saturday are weekends; disclosed peak dates apply. The final offer must identify cottage, dates, guests, inclusions, extras, total, deposit/balance, due dates and quote validity before acceptance.
Direct rates include stated cleaning and starter wood. Extra wood, champagne and firelighters require a quoted price and express acceptance; unpriced extras are unavailable to order. The Lantern’s existing Booking.com R100 mandatory wood fee remains where shown on that channel. Review the full total before committing. The operator is not VAT-registered: no accommodation VAT is added and no VAT tax invoice is issued.
These terms introduce no deposit percentage, security deposit or automatic card charge. Payment instructions/due dates must be agreed in the offer. Do not submit bank/card credentials through the enquiry form. Website updates do not retrospectively change accepted totals or cancellation conditions.
5. Cancellation and changes
Notify us promptly in writing with your reference. For channel bookings also use its cancellation/amendment process to align records/refunds. Changes require available dates and an agreed revised price.
Where the CPA applies, section 17 permits cancellation of advance bookings. Any charge must be fair considering the service, notice, diligent opportunities to re-let and industry practice. Re-letting proceeds and costs saved must be considered to avoid disproportionate recovery. Calling a deposit “non-refundable” does not automatically justify forfeiture. We explain deductions and refund the balance due.
No section 17 cancellation charge applies if death or hospitalisation prevents the person for whose benefit the booking was made from honouring it. Proportionate evidence may be requested privately. Other applicable statutory cancellation/cooling-off rights remain; no blanket online cooling-off period is promised for date-specific accommodation.
Specific cancellation conditions must be disclosed before booking, subject to mandatory law. No new percentage cancellation schedule is introduced here; each new direct offer needs reviewed cancellation terms.
6. If we cannot provide the stay
We notify you promptly, discuss suitable alternatives and provide the refund/remedy required by agreement and law. A materially different stay needs agreement. Applicable CPA section 47 refund, interest and directly incidental cost protections remain, subject to its provisions. Routine calendar failures are not automatically circumstances beyond the operator’s control.
Weather, outages and access issues are assessed on their facts; they do not create a blanket “no refund” rule or remove rights to agreed service quality, remediation or appropriate refund under CPA section 54.
7. Suitability and care
Tell us essential accessibility needs before booking so actual features can be explained; do not assume step-free access. Use stairs, fireplaces and outside areas carefully, supervise children and follow specific safety instructions. Forest/mountain paths can be wet and uneven. Report hazards/service issues promptly.
House rules, occupancy, pet arrangements and restrictions must be disclosed before confirmation. Proven damage unlawfully caused by guests requires fair evidence and a chance to respond; ordinary wear is not damage. No unagreed penalty or automatic damage debit is authorised.
8. Rights, liability and registration
No term excludes liability for gross negligence, waives a non-excludable right or requires indemnity for unlawful conduct. There is no general “all risks” waiver. Any lawful material risk notice must be prominent, explained before acceptance and allow time to understand it.
Guest registration records the version shown; it must not introduce unexpected material conditions after confirmation or remove statutory rights. Ask for your accepted copy. Previously signed agreements are not overwritten.
9. Privacy and marketing
Stay administration is covered by the privacy notice. Marketing consent is separate. Our cookie policy explains optional film choices.
10. Website use
Use the site lawfully; do not attempt unauthorised access, misuse calendar links or submit harmful material. Photos/film remain their owners’ property: Hogsback photographs © Ryan Brear; Lantern film by Dear Travallure. Viewing does not permit republication. Confirm destination access/conditions and charges with venues.
Errors will be corrected. An error does not automatically permit changing an agreed price or denying mandatory remedies. Outside services have their own terms; site downtime does not extinguish reservations.
11. Complaints
Contact us with reference, issue and requested remedy. You can also use the booking platform, an ombud with jurisdiction, the National Consumer Commission, provincial consumer authority or competent court. No compulsory private arbitration, distant exclusive court or shortened statutory claim period is imposed.
12. Law and versions
South African law and applicable mandatory CPA protections govern. An invalid term does not remove other lawful protections. Updates apply prospectively; changes to existing bookings need a lawful basis and agreement where required. Keep the confirmation and accepted version.
